MOScout Daily Update: Kalshi Sues Hanaway - Latest Campaign Expenditures - Mustoe to DOR? - JP’s Huge COH and more…
Breaking… Kalshi Sues Hanaway
Prediction market company Kalshi filed suit against Attorney General Catherine Hanaway in federal court.
Kalshi is asking the court to block Missouri from enforcing its gambling laws against the company, arguing that its sports prediction contracts fall under exclusive federal regulation rather than state oversight.
· Missouri’s attempt to prohibit Kalshi from operating is a form of regulation that intrudes on the federal scheme… The Supremacy Clause does not tolerate that result.
The Positive and the Negative
One MOScouter sent in these two mailers that he received on back-to-back days. It’s a reminder in these campaign days: your supporters will make you look and sound better than you are and your opponents will make you look much worse than you are. Almost like two different people…
Sabato: CD-2 Toss-up
The well-respected Sabato’s Crystal Ball moved the CD-2 race from “lean Republican” to “toss-up.” The explanation: To reflect the possibility of a Democratic megawave that pushes the party past 235 seats, we are moving several seats from Leans Republican to Toss-up. We may end up pushing many if not all of these races back to Leans Republican in our final ratings, though. These are open GOP-held seats in KY-6 and MT-1 as well as Reps. Jeff Crank (R, CO-5), Ann Wagner (R, MO-2), Brian Fitzpatrick (R, PA-1), and John McGuire (R, VA-5). These are all generally red-leaning seats…

Senate 8: JP’s COH
Eyebrows were raised that Speaker Jon Patterson’s PAC, Missouri Alliance PAC, still had over $1 million cash on-hand in its 8-Day Report.
One observer shrugged, saying that after you’ve spent $2 million on a Senate race, does the third million dollars really move the needle.
But another suggested JP was looking past this race and wanted to have a war-chest for future endeavors, and that “there are 3 senate races and a dozen house races where that money could make a meaningful impact.”
Mustoe to DOR
Word is that Barb Mustoe, Sen. Sandy Crawford’s chief of staff, will be headed to the Department of Revenue to be its new legislative director.
Osmack Channels Anti-A3 in County Council Race
Mark Osmack, running as a Democrat in St. Louis County Council District 3 against former Sen. Andrew Koenig, is injecting the abortion issue into his campaign.
Final Four in KC, KS?
Kansas City Business Journal reports that “the Kansas City Chiefs’ planned $3 billion stadium in Wyandotte County is a frontrunner to host the NCAA Men’s Final Four basketball tournament, months before construction has started. Kansas City, Kansas, is a finalist city to host the tournament between 2032 and 2036, the NCAA announced Tuesday.”
· This is just a bit of salt in the wound of losing the stadium to Kansas.
Hanaway Sues Indivior
Attorney General Catherine Hanaway sued Indivior which makes products to treat opioid use disorder, “OUD.” See the suit here.
Ignoring the dangers prevented by misused and diverted OUD products, Indivior engaged in aggressive and misleading marketing schemes to push doctors to prescribe more of its products than was necessary or appropriate. For example, Indivior’s marketing and sales representatives targeted multiple known prolific “pill mill” doctors, in an attempt to increase its Suboxone and Subutex revenue. Despite numerous red flags, and in some cases actual knowledge, that these doctors were mis-prescribing and significantly contributing to the diversion of Indivior’s products, Indivior continued to use these pill mills to increase its sales without regard for patient
safety.
· Indivior is represented in Jefferson City by Angie Schulte, Olivia Wilson, and Roger Collins.

Its first featured tool, Ballot Builder, explains the five statewide questions on Missouri's Nov. 3 ballot, one week before Election Day.”
· Red Eye was founded by David Jackson, Joe Lakin, and Jagan Kaliayperumal.
eMailbag on St. Louis County Early Voting
With the percentages of early voting in precincts that Trump lost in 2024, some of the suspect House Districts (HD94, HD96, HD100, HD101 and HD110) could already be decided. When a percent already has over 15% of those registered voted and that percent historically votes democrat, that’s hard to make up. But we shall see in about 8-days…
